California Assembly Bill 2216: Summary for Homeowners

We are writing to inform you about a new piece of legislation, Assembly Bill 2216 (AB 2216), which impacts tenancy and the acceptance of common household pets in rental properties. This bill, introduced by Assemblymember Matt Haney, aims to address issues related to pet ownership and rental housing. Here are the key points:

  1. Prohibition of Blanket No-Pet Policies: AB 2216 prohibits landlords from enforcing blanket no-pet policies. This means that landlords cannot universally ban pets from their rental properties without providing reasonable justifications.
  2. Restrictions on Pet-Related Fees: The bill also bans landlords from charging extra fees or “pet rent” for tenants with common household pets, such as cats and dogs. Additionally, landlords cannot collect separate security deposits for pets.
  3. Reasonable Justifications for Denial: Landlords must provide specific, reasonable reasons if they wish to deny a tenant’s pet. These reasons must be related to health and safety concerns, and landlords must present documentation to support their decision.
  4. Application Process Changes: Under the new law, landlords cannot inquire about pets until after approving a tenant’s application. Tenants must notify the landlord of their pet ownership at least three days before signing the lease. If a landlord decides to deny the pet, the tenant can then choose to seek housing elsewhere.
  5. Impact on High-Density Housing: The bill recognizes the practical challenges of pet ownership in high-density housing areas, where apartments often lack outdoor spaces. The legislation seeks to balance the needs of pet owners with those of other tenants and landlords.
  6. Exemptions for Small Properties: AB 2216 includes exemptions for smaller rental properties. Buildings with 15 or fewer units are not required to accept pets under this legislation.
